There are estimated to be approximately 10,000 properties in the areas of Coin, Alhaurin and Cartama that are not properly registered.
Nearly all lawyers will now be requesting an AFO licence from the vendors of all properties on rustic land. This certificate is issued by an architect that checks the property dimensions in line with the title deed and highlights any irregularities. The town hall local to the property then tax the vendor and approve the certificate where applicable.
This is a complex process and needs to be understood. Most vendors have now been made aware of this licence and are trying to put it in place but not many have it in place yet.
There are some instances where an AFO is not possible such as property built on protected land, There are areas where the town halls are very slow at issuing the certificates such as Cartama.
Also in some circumstances properties, sheds and pools can be registered before the point of sale so long as the land is not protected and the buildings have an antiquity licence. Your lawyer can advise you how this all works.
